Oxley AI — Terms of Service

1. Eligibility and Jurisdiction

• You must be at least 18 years old to use Oxley AI.
• Oxley AI is not directed to or intended for children.
• You are responsible for complying with all applicable laws in your jurisdiction.

2. License to Use

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for your own personal, non-commercial use, subject to these Terms.

You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract source code from the Services unless permitted by law.

3. Account Registration

• Provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• Notify us immediately of any unauthorized use of your account.

You may delete your account at any time through the Settings page in the app or by contacting info@theoxley.ai.

4. Subscriptions and Payments

Oxley AI offers optional paid subscription plans.

If you purchase a subscription:

• Payment will be charged to your Apple ID account at confirmation of purchase for iOS purchases.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel subscriptions through Settings → Apple ID → Subscriptions on your device.
• Any unused portion of a free trial will be forfeited when a subscription is purchased.
• Subscription prices may change with notice.
• Refunds for iOS purchases are handled through Apple’s refund policies.

Web purchases are processed through Stripe.

5. General Practices Regarding Use and Storage

• We may establish limits on use or storage (such as message history).
• We are not responsible for deletion or failure to store content.
• We may terminate inactive accounts after a reasonable period.

6. Notifications

You consent to receive service-related communications electronically, including emails and push notifications related to messages, account activity, and product updates. Notification preferences can be adjusted in your device or app settings.

7. User Conduct

You are solely responsible for all content you create, submit, or interact with (“User Content”). You may not use the Services to create, request, or share content that:

• depicts or promotes non-consensual sexual content or sexual violence
• involves minors in sexual contexts
• constitutes exploitation, grooming, or trafficking
• uses real people’s likenesses or voices without consent
• harasses, threatens, or abuses others
• contains hate speech or discrimination
• infringes intellectual property rights
• contains malware or attempts to disrupt the Services

Violation may result in suspension or termination of your account.

8. Voice and Media Features

Certain features allow voice input.

• You may not upload or generate likenesses or voices of real individuals without consent.
• You may not create deceptive impersonations or deepfakes.

Voice input may be processed by third-party speech recognition providers to generate responses.

9. AI-Generated Content

Content generated through Oxley AI is produced by artificial intelligence systems. AI companions are not real people and may generate responses that are inaccurate, biased, or inappropriate despite safety measures.

Oxley AI is intended for companionship, exploration, and entertainment purposes only and should not be relied upon for medical, psychological, legal, or financial advice.

If you are experiencing a crisis or emergency, please contact appropriate professional or emergency services.

10. Content Rights

You retain ownership of your original content. By using the Services, you grant Oxley AI a limited license to store, process, and use your content solely for the purpose of operating, maintaining, and improving the Services.

11. Termination

We may suspend or terminate your account if you violate these Terms or misuse the Services. Upon termination, your right to use the Services immediately ceases.

12. Indemnification

You agree to indemnify and hold harmless Oxley AI, its officers, employees, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from:

• your use of the Services
• your violation of these Terms
• your infringement of third-party rights

13. Disclaimers and Limitation of Liability

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, Oxley AI disclaims all warranties and will not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the Services.

14. Apple App Store Terms

• These Terms are between you and Oxley AI, not Apple Inc.
• Apple has no obligation to provide maintenance or support.
• Apple is not responsible for claims related to the app or your use of it.
• Apple is a third-party beneficiary of these Terms and may enforce them against users of the Services.

15. Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law principles.
